The amount of the fee will depend upon the complexity of the case. We will enter into a written agreement with the client which will specify the fees, and other charges, to be paid by the client, and when those fees and charges are to be paid. In the majority of cases, the fees are based upon an hourly rate. The hourly rates we charge will be competitive with rates charged in our geographical area.

In the past, the grounds for divorce had to involve conduct such as cruelty or adultery. Over time, legislators recognized that such types of grounds for divorce did not reflect reality. As a result, many states, including Kentucky, adopted no fault divorce. In these states, there is one ground for divorce, and that ground is the irretrievable breakdown of the marriage, which means that the parties can no longer get along together.

In general, misconduct plays no role in a divorce under Kentucky law insofar as property is concerned. Property is divided by the Court in just proportions without regard to the marital misconduct of either party, taking into account a variety of factors such as the length of the marriage, the contribution of each spouse to the acquisition of marital property, the age and health of each spouse at the time of the divorce, and the economic circumstances of each spouse at the time the property division is to become effective.
